According to the Migration Code of the Republic of Azerbaijan a permit for temporary residence in the Republic of Azerbaijan is not issued or extended to foreigners and stateless persons in the following cases (https://migration.gov.az/content/pdf/5d5e2952be6e9_MM%20(1).pdf):

1. In case it might harm national security of the Republic of Azerbaijan or public order;
2. In case they submit fraudulent documents or falsified information for the purpose of obtaining permit for temporary residence in the Republic of Azerbaijan;
3. In case they do not hold documents certifying their identities or they do not submit one or more of the documents set forth in Article 46 of the Migration Code;
4. In case there are less than 3 months until the expiry date of the passport or other border crossing document;
5. In case they are carriers of a virus of the disease included in the list of dangerous infectious diseases, approved by the relevant executive authority (except the persons who are married to citizens of the Republic of Azerbaijan);
6. In case they were expelled from the territory of the Republic of Azerbaijan previously and their entry to the country were restricted;
7. In case the ground justifying issuance of the permit for temporary residence in the territory of the Republic of Azerbaijan is removed and there are not any other grounds envisaged by the Migration Code regarding the issuance of temporary residence permit;
8. In case the persons who have submitted an application of consent envisaged by Article 46.1.10 of the Migration Code, apply for deregistration of the foreigner or stateless person and in case of failure to submit documents related to another place of residence for registration within 10 working days;
9. In case they stay beyond the territory of the Republic of Azerbaijan for more than 90 days within 180 days;
10. In case they leave the territory of the Republic of Azerbaijan for residing abroad permanently;
11. In case their stay in the Republic of Azerbaijan considered undesirable;
12. In case a decision on their expulsion from the territory of the Republic of Azerbaijan is made;
13. In case they violate the declared purpose of their arrival in the Republic of Azerbaijan during the period of temporary residence on the territory of the Republic of Azerbaijan;
14. In case of failure to pay the administrative fine imposed for violation of rules of stay and residence of foreigners and stateless persons in the Republic of Azerbaijan.

Note. The cases of refusal of issuance of a temporary residence permit as defined in Articles 50.1.4, 50.1.5, 50.1.6 and 50.1.12 of the Migration Code are not applied to foreigners and stateless persons who are considered as a victim of human trafficking, as well as who assist criminal prosecution authorities.

According to the Migration Code of the Republic of Azerbaijan a permit for temporary residence in the Republic of Azerbaijan is issued to foreigners and stateless persons in the following cases (https://migration.gov.az/content/pdf/5d5e2952be6e9_MM%20(1).pdf):

1. In case they are in close relationship with a citizen of the Republic of Azerbaijan;
2. In case they invest at least 500 000 manats in the economy of the country;
3. In case they possess real estate which is worth at least 100 000 manats in the territory of the Republic of Azerbaijan;
4. In case they deposit money in the amount of at least 100.000 manats in the banks functioning in the Republic of Azerbaijan on the basis of a term deposit agreement;
5. In case they are highly qualified specialists in the spheres of economy, industry, military, science, culture, sports, etc;
6. In case they are specialists envisaged by Article 64.0.8-1 of the Migration Code;
7. In case they are family members of foreigners or stateless persons temporarily or permanently residing in the territory of the Republic of Azerbaijan;
8. In case they hold positions of head or deputy head in the branch or representation of a foreign juridical person in the Republic of Azerbaijan;
9. In case they hold positions of head or deputy head of juridical person established in the Republic of Azerbaijan, the founder or at least one of the founders of which is a foreign juridical or physical person;
10. In case they engage in entrepreneurship activity in the Republic of Azerbaijan;
11. In cases envisaged by Articles 0.6, 64.0.6-1, 64.0.7, 64.0.9, 64.0.10, 64.0.11 and 64.0.17 of the Migration Code;
12. In case they obtain work permit in a way envisaged by this Code to carry out paid labour activity on the territory of the Republic of Azerbaijan;
13. In case they get full-time education at institutions of higher education and technical schools and in case they get education at secondary schools in the Republic of Azerbaijan;
14. In case they are engaged in professional religious activity at officially registered religious institutions;
15. In case they are considered as a victim of human trafficking;
16. In case they assist criminal prosecution authorities;
17. In case there are grounds envisaged by the international agreements of the Republic of Azerbaijan.

For the registration upon place of stay, it is necessary to apply, within 15 days (within 30 days for citizens of the Republic of Kazakhstan) after foreigner’s arrival in the country, via electronic services of the official website of the State Migration Service of the Republic of Azerbaijan, e-mail (qeydiyyat@migration.gov.az) or to regional migration departments, or "ASAN service" centers. It is possible to check the status by entering "Checking the Registration Status" or "Track of Applications" options on the "Electronic Services" section of the official website of the State Migration Service, as well as to obtain information on the number and validity of the registration upon place of stay through the “MigAz” mobile application (on the "Track of Applications" option).

1.For extension of temporary staying period

Application should be made for extension of temporary staying period in the Republic of Azerbaijan at least 3 business days (except the cases of emergency stop during transit) before the expiration of temporary staying period.

2.For temporary residence permission

Application should be made for obtaining permit for temporary residence at least 30 days before the expiration of the temporary staying or temporary residence period in the Republic of Azerbaijan.

3.For permanent residence permission

Application should be made for obtaining permit for permanent residence at least 3 months before the expiration of the temporary or permanent residence period in the Republic of Azerbaijan. 

4.For work permit

Employer should apply at least 30 days before the expiration of work permit.

Foreigners or stateless persons intending to stay more than 15 days in the territory of the Republic of Azerbaijan should get registered online (by entering “registration upon place of stay” section placed under the “E-service” window of the official website of the Service - www.migration.gov.az) or by directly applying to regional migration departments, as well as "ASAN service" centers within 15 days after arriving in the country.

Foreigners or stateless persons arriving upon visa – for the period of stay indicated on the visa;

Foreigners or stateless persons arriving under visa-free regime – for 90 days.

No state fee is required for registration of foreigners or stateless persons upon place of stay.

Temporary staying period of foreigners and stateless persons in the Republic of Azerbaijan can be extended in the following cases:

-         In case there is a need for urgent medical treatment of foreigners and stateless persons in the Republic of Azerbaijan;

-        In case of serious illness or death of foreigner’s and stateless person’s any close relative residing in the Republic of Azerbaijan;

-         In case there is a justified application on incompleteness of intended work by foreigners and stateless persons arrived related with official necessity, submitted by organization inviting those persons;

-         In case of a natural disaster that hinders the traffic during the transit;

-       In case a vehicle (or its parts) is out of order or there is a need for repair as a result of road accident (if a relevant document is submitted) during the transit;

-        In case the persons passing the territory of the Republic of Azerbaijan get sick(in this case, there should be a reference of a doctor certifying that the continuation of transit is dangerous for the health of the sick person) during the transit;

If temporary staying period of foreigners or stateless persons is extended up to 30 days 30 manats state fee, if such period is extended up to 60 days 60 manats state fee is required. For persons under age of 18 up to 30 days 15 manats state fee, up to 60 days 30 manats state fee is required.

Foreigners and stateless persons are issued permit for temporary residence in the Republic of Azerbaijan in the following cases:

-         In case they are in close relationship with a citizen of the Republic of Azerbaijan;

-         In case they invest at least 500 000 manats in the economy of the country;

-         In case they possess real estate which is worth at least 100 000 manats on the territory of the Republic of Azerbaijan or funds in the same amount in the banks of the Republic of Azerbaijan;

-         In case they are highly qualified specialists in the spheres of economy, industry, military,science, culture, sports, etc;    

       - Specialists included to the category defined by relevant executive authority who have been invited by the citizens of the Republic of Azerbaijan or juridical persons established in the Unofficial translation Republic of Azerbaijan for the purpose of doing works or rendering services in the activity areas determined by the relevant executive authority; 

-         In case they are family members of foreigners and stateless persons temporarily or permanently residing on the territory of the Republic of Azerbaijan;

-         In case they hold positions of head or deputy head in the branch or representation of a foreign juridical person in the Republic of Azerbaijan;

      - In case they hold positions of head and deputy head of juridical person, which is established in the Republic of Azerbaijan and founder or at least one of the founders of which is a foreign juridical or physical person;

-         In case they engage in entrepreneurship activity in the Republic of Azerbaijan;

-         In case they obtain work permit in a way envisaged by this Code to carry out paid labor activity on the territory of the Republic of Azerbaijan;

-         In case they get full-time education at institutions of higher education and technical schoolsand in case they get education at secondary schools in the Republic of Azerbaijan;

-         In case they are engaged in professional religious activity at officially registered religious institutions;

-         In case there are grounds envisaged by the international agreements of the Republic of Azerbaijan.

To foreigners or stateless persons investing at least 500 000 manats in the economy of the country permit for temporary residence in the Republic of Azerbaijan is issued for the period mentioned on the application of the applicant, but for a period not exceeding 3 years and can be extended each time for the period not exceeding 3 years, if there is a relevant ground.

In all other cases permit for temporary residence in the Republic of Azerbaijan is issued for the period mentioned on the application of the applicant, but for a period not exceeding 1 year and can be extended each time for the period not exceeding 2 years, if there is a relevant ground.

Following state fees are required for issuance of permission card for temporary residence in the territory of the Republic of Azerbaijan to foreigners and stateless persons and for extension of its validity :

Up to 3 months                    30 manats

Up to 6 monts                      60 mamants

Up to one year                     120 manats

Up to one year 6 months    180 manats

Up to 2 years                       240 manats

Up to 2 years 6 months      300 manats

Up to 3 years                       360 manats

Following state fees are required for issuance of permission card for temporary residence in the territory of the Republic of Azerbaijan to foreigners and stateless persons under age of 18 and for extension of its validity :

Up to 3 months                    15 manats

Up to one year                     60 manats

Up to one year 6 months      90 manats

Up to 2 years                        120 manats

Up to 2 years 6 months         150 manats

Up to 3 years                          180 manats
