When applying for a work permit (for countries with a visa regime) a labour or business visa is required.

 

Persons residing on the territory of the Republic of Azerbaijan apply to the State Migration Service (through regional migration departments and "ASAN service" centers), and persons residing abroad apply to the Ministry of Foreign Affairs via diplomatic representations or consulates of the Republic of Azerbaijan for acquisition, restoration and revocation of citizenship of the Republic of Azerbaijan.

Acquisition of citizenship of the Republic of Azerbaijan

According to the “Law on Citizenship of the Republic of Azerbaijan” of the Republic of Azerbaijan a foreigner or a stateless person who legally resides on the territory of the Republic of Azerbaijan uninterruptedly and permanently for the last 5 years, who has legal source of income and undertakes to abide by the Constitution and Azerbaijani legislation, as well submits a document certifying his/her knowledge of the state language, can be admitted to the citizenship of the Republic of Azerbaijan upon his/her own application in line with the Law of the Republic of Azerbaijan “On the Citizenship of the Republic of Azerbaijan”, regardless of his/her origin, race and nationality, sex, educational background, language, religious views, political and other convictions.

 

The term of permanent residence on the territory of the Republic of Azerbaijan of a foreigner or stateless person is calculated from the date of issuance of permanent residence permit in a way envisaged by the legislation.

 

Restoration of Citizenship of the Republic of Azerbaijan

According to the Law of the Republic of Azerbaijan “On the Citizenship of the Republic of Azerbaijan”, a person, who has been previously a citizen of the Republic of Azerbaijan, or whose citizenship has been terminated, can have his/her citizenship of the Republic of Azerbaijan restored upon his/her own application, taking into account the restrictions reflected in the second part of Article 14 of the Law of the Republic of Azerbaijan “On the Citizenship of the Republic of Azerbaijan”.

 

Revocation of citizenship of the Republic of Azerbaijan

According to the Law of the Republic of Azerbaijan “On the Citizenship of the Republic of Azerbaijan” the citizenship of the Republic of Azerbaijan shall be revoked in the following cases:

  1. As a result of secession from citizenship of the Republic of Azerbaijan;
  2. As a result of loss of the citizenship of the Republic of Azerbaijan;
  3. If there are grounds foreseen under international treaties of the Republic of Azerbaijan;
  4. If there are other grounds foreseen under this Law.

Revocation of the citizenship of the Republic of Azerbaijan shall be made upon application of the person in accordance with this Law.

Applications are received by mail, through ASAN Service and regional migration departments, as well as electronically (by entering the “Write a letter” option of the “Contacts” section on www.migration.gov.az).

 

According to the Migration Code of the Republic of Azerbaijan in the following cases the obtaining of a work permit is not required (https://migration.gov.az/content/pdf/5d5e2952be6e9_MM%20(1).pdf):

  1. Persons holding permit for permanent residence in the territory of the Republic of Azerbaijan;
  2. Persons engaged in entrepreneurship activity in the territory of the Republic of Azerbaijan;
  3. Employees of diplomatic representations and consulates;
  4. Employees of international organizations;
  5. Heads of the organizations established under international agreements and their deputies;
  6. Persons employed by relevant executive authority;
  7. Military personnel and specialists invited for service or work in Armed Forces of the Republic of Azerbaijan and other armed units established pursuant to the legislation of the Republic of Azerbaijan;
  8. Employees of mass media accredited in the Republic of Azerbaijan;
  9. Persons dispatched for a business trip for not more than 90 days within a year to the Republic of Azerbaijan in the spheres of activity defined by the Cabinet of Ministers of the Republic of Azerbaijan;
  10. Specialists included to the category defined by the President of the Republic of Azerbaijan who have been invited by the citizens of the Republic of Azerbaijan or juridical persons established in the Republic of Azerbaijan for the purpose of doing works or rendering services in the activity spheres determined by the President of the Republic of Azerbaijan;
  11. Seamen;
  12. Academic staff and lecturers invited to institutes of higher education for delivering lectures;
  13. Art workers, trainers and sportsmen invited to work in sport clubs registered at relevant executive authority;
  14. Persons engaging in professional religious activity in the officially registered religious institutions;
  15. Heads of branches and representations of foreign juridical persons in the Republic of Azerbaijan and their deputies;
  16. Heads and deputy heads of juridical person established in the Republic of Azerbaijan, the founder or at least one of the founders of which is foreign juridical or physical person;
  17. Persons married with the citizen of the Republic of Azerbaijan, provided that the citizen is registered on the territory of the Republic of Azerbaijan upon place of residence;
  18. Persons submitted application for obtaining refugee status, obtained refugee status or granted political asylum;
  19. Persons who are considered a victim of human trafficking or providing assistance to criminal investigation bodies;
  20. Persons having in their custody citizens of the Republic of Azerbaijan who are under the age of 18 or I group disabled persons.
  21. Persons involved in labour activity in cases defined by the President of the Republic of Azerbaijan.

Applications for permanent residence permit are received at “ASAN service” centers, regional migration departments or electronically (by entering the “Obtaining a Work Permit” or “Extension of Work Permit” options of the “Electronic services” section on www.migration.gov.az).

On the official website of the State Migration Service, you can get information about the status of the application on the “Track of Applications” option (“Electronic services” section), as well as  obtain the payment code through the “Search for Payments” option. Payments can be made on the official website of the State Migration Service via the “Online-Payment” option (“Electronic services” section), bank branches, as well as via “ExpressPay” and ASAN payment terminals.

According to the Migration Code of the Republic of Azerbaijan a permit for permanent residence in the Republic of Azerbaijan is not issued or extended to a foreigner and stateless person in the following cases (https://migration.gov.az/content/pdf/5d5e2952be6e9_MM%20(1).pdf):

  1. In case it might harm national security of the Republic of Azerbaijan or public order;
  2. In case they are carriers of a virus of dangerous infectious diseases included in the list approved by the relevant executive authority (except the persons who are married to citizens of the Republic of Azerbaijan);
  3. In case they do not hold documents certifying their identities or they do not submit one or more of the documents set forth in Article 53 of this Code;
  4. In case they submit fraudulent documents or falsified information for the purpose of obtaining permit for permanent residence in the Republic of Azerbaijan;
  5. In case they are imprisoned for an intentionally committed serious crime or especially serious crime, if their sentence is not served or removed in a way envisaged by the Law;
  6. In case they do not have necessary funds to meet the minimal needs of themselves and their family members (except the cases when a close relative who is a citizen of the Republic of Azerbaijan or a person holding a permit for permanent residence in the Republic of Azerbaijan undertakes to financially support them while they are in the country);
  7. In case the person who has taken over the financial security of the foreigner or stateless person (family members accompanying him/her) applies for a refusal of such security and and in case of failure to submit another document on provision of minimum needs of himself/herself and accompanying family members within 10 working days;
  8. In case the persons who have submitted an application of consent envisaged by Article 53.1.14 of the Migration Code, apply for deregistration of the foreigner or stateless person and in case of failure to submit documents related to another place of residence for registration within 10 working days;
  9. In case they leave the territory of the Republic of Azerbaijan for residing abroad permanently;
  10. In case the total number of days spent outside the territory of the Republic of Azerbaijan during any year, calculated from the date of issuance of the permanent residence permit, is more than 180 days (this condition does not apply to persons who have obtained the relevant permit on the grounds provided for in Articles 45.1.2 and 45.1.7 of the Migration Code);
  11. In case the grounds justifying issuance of permit for temporary residence in the territory of the Republic of Azerbaijan are removed;
  12. In case their stay in the Republic of Azerbaijan considered undesirable;
  13. In case a decision on their expulsion from the territory of the Republic of Azerbaijan is made;
  14. In case they violate the declared purpose of their arrival in the Republic of Azerbaijan during the period of permanent residence on the territory of the Republic of Azerbaijan;
  15. In case of failure to pay the administrative fine imposed for violation of rules of stay and residence of foreigners and stateless persons in the Republic of Azerbaijan.

Foreigners and stateless persons are issued permit for permanent residence in the Republic of Azerbaijan in the following cases:

 

Foreigners and stateless persons temporarily residing for the last 2 years without interruption on the territory of the Republic of Azerbaijan on the basis of a relevant permit (except the persons who obtained temporary residence permit for being family member of the foreigners or stateless persons issued permission for temporary residence on the territory of the Republic of Azerbaijan on the grounds provided by Article 45.1.8-45.1.11 of the Migration Code) can submit application to obtain permit for permanent residence on the territory of the Republic of Azerbaijan on the following grounds:

 

  1. In case they are in close relationship with a citizen of the Republic of Azerbaijan;
  2. In case they invest at least 500 000 manats in the economy of the country;
  3. In case they possess real estate which is worth at least 100 000 manats in the territory of the Republic of Azerbaijan;
  4. In case they deposit money in the amount of at least 100.000 manats in the banks functioning in the Republic of Azerbaijan on the basis of a term deposit agreement;
  5. In case they are highly qualified specialists in the spheres of economy, industry, military, science, culture, sports, etc;
  6. In case they are specialists included to the category defined by the President of the Republic of Azerbaijan who have been invited by the citizens of the Republic of Azerbaijan or juridical persons established in the Republic of Azerbaijan for the purpose of doing works or rendering services in the activity spheres determined by the President of the Republic of Azerbaijan;
  7. In case they are family members of foreigners or stateless persons temporarily or permanently residing in the territory of the Republic of Azerbaijan;
  8. In case they hold positions of head or deputy head in the branch or representation of a foreign juridical person in the Republic of Azerbaijan;
  9. In case they hold positions of head or deputy head of juridical person established in the Republic of Azerbaijan, the founder or at least one of the founders of which is a foreign juridical or physical person;
  10. In case they engage in entrepreneurship activity in the Republic of Azerbaijan.

 

Applications for permanent residence permit are received at “ASAN service” centers, regional migration departments or electronically (by entering the “Permission for permanent residence” option of the “Electronic services” section through www.migration.gov.az).

Applications for extending temporary staying period are received at “ASAN service” centers, regional migration departments or electronically (by entering the “Extension of Temporary Staying” option of the “Electronic services” section through www.migration.gov.az).

 

On the official website of the State Migration Service, you can get information about the status of the application on the “Track of Applications” option (“Electronic services” section), as well as  obtain the payment code through the “Search for Payments” option. Payments can be made on the official website of the State Migration Service via the “Online-Payment” option (“Electronic services” section), bank branches, as well as via “ExpressPay” and ASAN payment terminals.

 

During the pandemic temporary staying period of persons, whose registration upon place of stay ends, is automatically extended by the SMS through the system without collecting any documents, as well as the stay of foreigners (who paid the relevant state fee) in the country, whose temporary staying period (visa period or 90 days) has been extended for 60 days is considered legal without additional application and payment of the state fee until the restrictions on movement at the state border are lifted.

According to the Migration Code of the Republic of Azerbaijan temporary staying period of foreigners and stateless persons can be extended in the following cases (https://migration.gov.az/content/pdf/5d5e2952be6e9_MM%20(1).pdf):

  1. In case there is a need for urgent medical treatment of foreigners and stateless persons in the Republic of Azerbaijan;
  2. In case of serious illness or death of foreigner’s and stateless person’s any close relative residing in the Republic of Azerbaijan;
  3. In the cases set forth in Article 19.4 of the Migration Code:
  • During the transit, emergency stop of foreigners and stateless persons in the territory of the Republic of Azerbaijan more than the period indicated on the visa is possible in the following cases:
  • In case of a natural disaster that hinders the traffic;
  • In case a vehicle (or its parts) is out of order or there is a need for repair as a result of road accident (if a relevant document is submitted);
  • In case the persons passing the territory of the Republic of Azerbaijan get sick (in this case, there should be a reference of a doctor certifying that the continuation of transit is dangerous for the health of the sick person);
  1. In case temporary staying period of the father, mother, husband (wife), child, brother, sister of a foreigner or stateless person in the Republic of Azerbaijan is extended.

In case emergency stop happens during a transit, temporary staying period of foreigners and stateless persons in the Republic of Azerbaijan is extended until the time when the grounds for the emergency stop are removed, in compliance with Articles 41-43 of the Migration Code.

In the case provided for in Article 19.4.3 of the Migration Code, if the patient is accompanied by close relatives, the emergency stop also applies to them.

Applications for temporary residence permits are received at “ASAN service” centers, regional migration departments or electronically (by entering the “Permission for temporary residence” option of the “Electronic services” section through www.migration.gov.az).
