Official statistics of the State Migration Service of Azerbaijan Republic for November 2012

Relevant measures towards implementation of state policy in migration sphere, strengthening state control over migration processes, management and regulation of migration processes, as well as preparation and realization of measures for prevention of illegal migration have been conducted by State Migration Service of Azerbaijan Republic in November 2012.

During November 1.931 cases concerning infringement of requirements of administrative legislation by foreigners and stateless persons without observing rules of stay, temporary and permanent residence in Azerbaijan Republic have been defined. 292 of detained foreigners were fined and their residence in the country was legalized because of having grounds for stay and residence in compliance with the legislation. Decisions on 1.520 foreigners to leave the territory of Azerbaijan Republic within 48 hours and decisions on 119 foreigners to be expelled out of the boundaries of the country in administrative order were adopted. Majority of foreigners who were expelled and whose entrance to the country was restricted mainly were citizens of Russian Federation (28 persons) and Republic of Turkey (27 persons).

In general, during the month foreigners and stateless persons committed administrative offence have been fined from 300 manats up to 400 manats with or without being expelled from the country; 1488 of them under Article 339.1.1 (stay and residence in Azerbaijan Republic without right entitling documents, thus unregistered residence), 176 persons under Article 339.1.2 (stay and residence in Azerbaijan Republic with invalid documents), 27 foreigners under Article 339.1.4 (violating defined rules of legislation when being employed), 5 foreigners under Article 339.1.6 (refusing to leave after the expiration of period defined by legislation) of the Administrative Offences Code of Azerbaijan Republic. 116 foreigners were not applied administrative amenability because of being under age of 16.  

As well as inspections have been conducted in a number of entrepreneurial subjects by employees of State Migration Service of Azerbaijan Republic in order to reveal and prevent cases of foreigners’ and stateless persons’ involvement in paid labour activity without obtaining work permit by employer by violating requirements of country legislation. As a result of taken measures 13 cases concerning infringement of rules of foreigners’ and stateless persons’ involvement in paid labour activity have been revealed in entrepreneurial subjects. Foreigners involved in illegal labour activity without obtaining work permit are mainly Turkish, China and Georgian citizens.

6.276 foreigners’ and stateless persons’ applications related with extension of temporary staying period in the country, granting temporary and permanent residence permissions, acquiring, revocation, restoration of citizenship, determination of refugee status and citizenship, as well as granting and extension of work permits for carrying out labour activity were submitted to the State Migration Service during November of current year. Each application was investigated in compliance with the requirements of legislation of Azerbaijan Republic and proper decisions were adopted.

Relevant measures towards strengthening state control over migration sphere are being continued by State Migration Service of Azerbaijan Republic.
